Can I sue a doctor for telling my family about my uncles terminal illness?

My uncle has had an illness for many years, he elected to keep it a secret, and did for many years. However a few years ago his doctor accidentally informed a few of his family members in full detail about his illness. This has caused an enormous amount of embarrassment and hard ship for several people in his family including my mother, three brothers, my self, and most especially, my uncle. Would the doctor responsible be required to pay restitution for the damage his mistake caused?|||You can't sue anybody as it was not your health information that was released.





Second, the release of the information may have been necessary for treatment choices for the patient





And please explain how this caused you or anybody else a hardship? If nobody outside the family knows about his HIV then all it did was circle around the family and nobody outside the family knows.





I am saying HIV because this is the only disease that would make him keep it to himself, and would cause family members to be shocked, and you didn't mention a wife.





A cancer is not a disease that people hide and it would have shown itself already and that is not a disease that people get embarrassed about.





But nobody can sue the doctor expect him and even then depending on the situation there is probably no lawsuit|||What damage did you suffer from this? It's not private information about you, so what reason do you have to sue the doctor? The only one that might have a case is your uncle, and only him. But he probably will have better results if he just reported it to the head of the clinic/hospital the doctor works for.



If he wishes to pursue it further, then he needs to contact a lawyer. But you have nothing to do with the case, other than maybe being a witness for him.|||Maybe you should celebrate your uncles life so he doesn't die knowing the fact that his illness has caused such an embarrassment for you. i feel sorry for you, being so embarrassed. but it's okay, you're uncle is just slowly dying.


look at the big picture, douche. you're just looking for money, i bet when your uncle dies you'll be crying poor mouth then too.


some advice, smoke heavily or play with asbestos and maybe with a terminal illness you'll understand how much of a selfish embarrassment YOU are!!


i really hope you have a vasectomy/hysterectomy, what will the world come to with your offspring?!|||First of all, you can't sue for anything as you have no standing. Second, what kind of damages did anybody suffer as a result of knowing this information? Embarrassment, sure, I can see that but hardship? What kind of hardship? Knock it off.|||Take your case to 3 or 4 local lawyers. If they all laugh you out of their offices (and they certainly should) you will have your answer.
